• All written or verbal estimates provided are preliminary assessments based on visible conditions and the information provided by the customer.​

• Estimates are subject to revision if hidden, unforeseen, or structural complications (e.g., concealed rot, electrical code violations, mold, or plumbing defects) are discovered during the physical execution of work.

• Any modification to the original scope of work will be presented via a Change Order and must be approved before additional work proceeds.

2. Text Messaging (SMS & MMS) Terms
By providing your mobile phone number on our website forms, via email, or during service inquiries, you explicitly consent to receive transactional, operational, and informational text messages (such as estimate confirmations, appointment reminders, media requests, invoices, and service updates) from De La Luz Services LLC.

• Usage Rights: You grant De La Luz Services LLC a non-exclusive, internal license to review, store, and utilize this media solely for evaluating, estimating, and executing your requested services.

• Restrictions: You agree not to transmit any media that violates third-party privacy rights, contains unlawful content, or exposes unrelated sensitive personal data.

4. Customer Responsibilities and Property Access
To ensure efficient service delivery, customers must adhere to the following responsibilities:

• Access: The customer must ensure that our technicians have safe, unobstructed access to the designated property at the scheduled date and time.

• Permits and Authorizations: It is the customer's sole responsibility to secure all necessary permits, variances, or formal permissions required by landlords, Homeowners Associations (HOAs), or local municipalities prior to the commencement of work.

• Working Conditions: The property must provide a safe environment for our technicians, free from active hazards, unrestrained pets, or hostile conditions.

5. Payment Terms

• Payment is due immediately upon completion of the specified services unless alternative terms are explicitly authorized in writing.

• We accept standard payment methods as designated on our invoices.

• Delinquent balances or late payments may be subject to standard processing fees or legal collection activities as permitted under Florida law.

6. Limitation of Liability and Indemnification

• De La Luz Services LLC maintains standard commercial general liability insurance.

• To the fullest extent permitted by law, De La Luz Services LLC shall not be liable for indirect, incidental, or consequential damages resulting from the use of our services or website.

• The customer agrees to indemnify, defend, and hold harmless De La Luz Services LLC against claims, liabilities, or expenses arising from the customer’s failure to secure necessary permissions (such as landlord or HOA approvals).

7. Governing Law and Jurisdiction
These Terms and Conditions are governed by, interpreted, and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal actions or disputes arising from these terms or our services shall be filed exclusively in the courts located in Tampa, Hillsborough County, Florida.
